ROSE ON FIRE ONLINE STORE TERMS AND CONDITIONS

Effective from: 12.08.2026

1. General Provisions

  1. These Terms and Conditions govern the use of the Rose on Fire online store available at www.roseonfire.eu and the conclusion and performance of sales contracts through the Store.
  2. The Store operates under the Rose on Fire brand and is operated by:

  1. The Seller may be contacted by e-mail at store.roseonfire@gmail.com or by telephone at +48 663 676 907.
  2. These Terms and Conditions are available free of charge on the Store's website in a form that allows them to be saved, reproduced and retained.
  3. Use of the Store requires a device with Internet access, an up-to-date web browser and an active e-mail address.

2. Products

  1. Rose on Fire offers clothing and accessories presented in the Store.
  2. Information about the products, including their description, composition, size, colour and price, is available on the relevant product pages.
  3. Product photographs are for illustrative purposes. The actual colour of a product may differ slightly from the colour displayed on a screen depending on the device and display settings.
  4. The Seller makes reasonable efforts to ensure that product information is accurate and up to date.
  5. Product prices displayed in the Store are gross prices and include VAT where applicable under the relevant regulations.
  6. Product prices do not include delivery costs unless otherwise stated on the product page or during checkout.

3. Orders

  1. Orders may be placed through the online Store.
  2. To place an order, the Customer selects a product, its available variant and quantity, and then proceeds to the shopping cart and checkout.
  3. Before placing an order, the Customer is provided with information about the product, price, delivery costs and available payment methods.
  4. Placing an order constitutes an offer by the Customer to conclude a sales contract.
  5. After placing an order, the Customer will receive confirmation that the order has been received at the e-mail address provided.
  6. The sales contract is concluded once the Seller confirms acceptance of the order for processing.
  7. If the Seller is unable to fulfil an order, the Customer will be informed without undue delay. If payment has already been made, the Seller will refund the funds received.
  8. The Customer is responsible for providing accurate and up-to-date information necessary to process the order.

4. Prices and Payments

  1. Current product prices are displayed next to the relevant products in the Store.
  2. Customers may pay using the payment methods available during checkout.
  3. Where advance payment is required, the order will be processed once payment has been confirmed.
  4. The Seller is not responsible for delays caused by banks, payment providers or other entities processing payments.

5. Delivery

  1. Products are delivered to the address provided by the Customer during checkout or to a selected collection point where such delivery is available.
  2. Available delivery methods and their costs are displayed to the Customer before the order is placed.
  3. The Store may offer, in particular, the following delivery methods:
    • InPost Parcel Locker,
    • Courier.
  4. Where InPost Parcel Locker delivery is selected, the Customer may be asked to select a specific Parcel Locker using the available InPost functionality.
  5. The estimated delivery time is stated in the Store or in the order confirmation.
  6. Unless a different delivery period has been agreed, the Seller will deliver the product without undue delay and no later than 30 days after the conclusion of the sales contract.
  7. If delivery is delayed due to the carrier, the Seller will take appropriate steps to clarify the situation.

6. Right of Withdrawal

  1. A consumer who enters into a distance sales contract has the right to withdraw from the contract without giving any reason within 14 days from the date on which the product is received.
  2. If an order consists of several products delivered separately, in batches or in parts, the withdrawal period begins on the date on which the last product, batch or part is received.
  3. To start the return procedure, the Customer should contact the Seller by e-mail before sending the product back at:

The e-mail should state the intention to withdraw from the contract and include the order number.

  1. After receiving the e-mail, the Seller will provide the Customer with information regarding the return procedure.
  2. Contacting the Seller by e-mail before sending the product back is required for the proper organisation of the return procedure. This does not limit the consumer's statutory right to submit a withdrawal statement in another clear and unequivocal form.
  3. After informing the Seller of the withdrawal, the Customer should return the product without undue delay and no later than 14 days from the date on which the Seller was informed of the withdrawal.
  4. The returned product should be in a condition that allows its nature, characteristics and functioning to be assessed. Where possible, the product should be unworn, unused, with its original tags attached and in its original packaging.
  5. The consumer may examine the product only to the extent necessary to establish its nature, characteristics and functioning. If the product is handled beyond this extent, the consumer may be liable for any resulting reduction in its value in accordance with applicable law.
  6. The direct cost of returning the product is borne by the Customer, unless applicable law requires the Seller to bear that cost.

  1. Parcels sent without prior e-mail contact, cash-on-delivery parcels or parcels sent at the Seller's expense will not be accepted, except where applicable law requires otherwise.

7. Refunds

  1. Following a valid withdrawal from the contract, the Seller will refund all payments received from the Customer, including the cost of the least expensive standard delivery method available in the Store.
  2. If the Customer selected a more expensive delivery method, the Seller is not required to refund the difference between that method and the least expensive available delivery method.
  3. The refund will be made without undue delay and no later than 14 days from the date on which the Seller receives the withdrawal statement.
  4. The Seller may withhold the refund until the returned product has been received or the Customer has provided evidence that the product has been sent back, whichever occurs first.
  5. The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to another method that does not result in additional costs.

8. Complaints and Non-Conformity of Goods

  1. The Seller is responsible to the consumer for the conformity of the product with the contract in accordance with applicable law.
  2. If a product does not conform to the contract, the Customer may submit a complaint by contacting the Seller at:

  1. Where possible, the complaint should include a description of the issue and the remedy requested. Proof of purchase may facilitate the processing of a complaint, but the Seller may not make acceptance of a complaint conditional upon presentation of a receipt.
  2. The Seller will respond to the complaint within 14 days of receiving it.
  3. In the case of a complaint concerning non-conformity of goods with the contract, the Customer does not bear costs that are required by law to be borne by the Seller in connection with bringing the product into conformity with the contract.
  4. Nothing in these Terms and Conditions limits the consumer's statutory rights.

9. Damaged or Incorrect Orders

  1. Customers should, where reasonably possible, inspect their delivery upon receipt.
  2. If a product is damaged, defective or different from the product ordered, the Customer should contact the Seller as soon as reasonably possible at store.roseonfire@gmail.com.
  3. The Seller will take appropriate steps to investigate and resolve the matter in accordance with applicable law.

10. Non-Returnable Products

  1. The statutory right of withdrawal is subject to exceptions provided by applicable law.
  2. Gift cards are non-refundable, subject to the consumer rights provided by applicable law.

11. Exchanges

  1. The Store does not offer direct product exchanges as part of its standard return procedure.
  2. If a Customer wishes to receive a different product, the recommended procedure is to return the original product and place a separate order for the desired product.
  3. This does not affect the Customer's statutory rights in cases where the product does not conform to the contract.

12. Personal Data

  1. Customers' personal data is processed in accordance with applicable law and the Rose on Fire Privacy Policy.
  2. Detailed information about the processing of personal data is available in the Privacy Policy published at www.roseonfire.eu.

13. Out-of-Court Consumer Dispute Resolution

  1. Consumers may use available out-of-court methods of consumer dispute resolution in accordance with applicable law.
  2. Consumers may obtain information about their rights and available methods of pursuing claims from the relevant consumer protection authorities.

14. Final Provisions

  1. Matters not covered by these Terms and Conditions are governed by Polish law, subject to mandatory provisions protecting consumers where applicable.
  2. No provision of these Terms and Conditions is intended to restrict any consumer rights granted by mandatory applicable law.
  3. The Seller may amend these Terms and Conditions for important reasons, including changes in applicable law or changes to the operation of the Store.
  4. Orders placed before an amendment takes effect will be governed by the version of the Terms and Conditions applicable at the time the order was placed.
  5. These Terms and Conditions are effective from 12.08.2026.
